1. Site Purpose
The purpose of this Site is to provide the User with public information about and related to CWT and its products and services. When transacting business with CWT or using CWT Technology, different or additional terms and conditions will apply, including product / service specific T&C detailed below where you are using such product / service.
2. Limitation of liability
No warranty to the User is provided concerning the following:
(i) The absence of anomalies, errors and bugs liable to affect navigation on the Site or the implementation of any functionalities proposed on the Site, or even the use of software accessed on or through the Site
(ii) The possibility of correcting anomalies, errors or bugs
(iii) The absence of Site breakdowns or service interruptions
(iv) The Site’s compatibility with specific materials or configurations
CWT is in no way responsible for failures due to third-party software, regardless of whether these are incorporated into the Site or provided via the Site.
CWT is in no way responsible for any damage, direct or indirect, whether foreseeable or unforeseeable (including loss of profits or opportunities) linked to the provision and/or use or the total or partial failure to use the Site functionalities, including the responsibility associated with any viruses likely to infect the User’s computer equipment.
In any case, the User acknowledges that he or she takes into account the characteristics and limitations of the Internet, and in particular its technical performance, the response time for consulting, requesting or transferring data and the risks linked to online security.
3. Hyperlinks to third party sites
The User may access third-party sites through hyperlinks present on the Site. CWT cannot be held responsible for the information posted on third-party sites nor third party sites’ handling of Users’ personal data, which remains the sole responsibility of those sites.
CWT does not authorize hyperlinks to any pages of its Site except the homepage, regardless of the type of link, without prior written consent.
4. Intellectual property
The Site, its content and all constituent elements, are original works for which CWT and/or its licensors, hold the full intellectual property rights and/or commercial rights, in particular copyright, data base rights, brand rights and rights pertaining to drawings or models.
The Site, as well as its software, databases, texts, information, analyses, images, photos, charts, logos, sounds and any other content on the Site, remain the exclusive property of companies of the CWT and/or its licensors or of the respective owners with whom the latter has/have made user agreements.
The User is granted a non-exclusive, non-transferable right to use the Site and its information in a private context. This right consists of (i) a right to consult online data and information contained on the Site and (ii) a right of reproduction consisting of printing and/or saving consulted data and information. This right of use applies only to use for strictly personal purposes.
All other uses of the Site by the User, notably for commercial purposes such as resale, are forbidden. The User may not for any other than personal purposes, reproduce, display, distribute, transmit, translate, adapt, circulate or communicate wholly or partially in any form any of the Site’s elements or information.
In addition, the User may not by any means introduce any information that may modify or damage the Site’s content or presentation.
5. Digital Services Act
CWT does not allow, nor support, any third-party content uploads. In the event User believes that certain content on CWT Technology is illegal, please use the following email address to notify CWT of such content: CWTlegalnotices@mycwt.com.
CWT has designated CWTlegalnotices@mycwt.com as the Digital Services Act Article 11 single point of contact for direct communications with the European Commission, Member States’ Authorities, and the European Board for Digital Services in respect of DSA matters. Please make the communications to the above-noted email address in English.
6. No Advice, Your Responsibility to Validate Information
All information accessible via the Site is provided "as is". CWT provides no explicit or implicit warranty and assumes no responsibility regarding the use of this information.
Information accessible via the Site is necessarily general in nature, does not represent professional, health or legal advice, is not intended to be comprehensive and may not be relevant to your particular circumstances. Please consult directly with public authorities and/or primary local information sources, including medical and other accredited experts familiar with your particular circumstances in one or more relevant locations as needed to validate all information on the Site. Any refunds and/or associated charges are subject to the policy of airlines, hotels and other travel suppliers. While CWT aims to implement regular information updates, circumstances can change with immediate impacts, creating complex circumstances with widely differing individual inpacts rendering information on the Site outdated or inapplicable to your circumstances. In all cases you are responsible for independently informing and updating yourself on any applicable restrictions or requirements for any actual or proposed trip.
Photos and documents on this Site do not represent or create contractual commitments for CWT.
The User agrees not to transmit to the Site any information that may lead to civil or criminal liability and agrees not to divulge via the Site any information which is illegal, libelous or against the public order.
7. Severability
If any provision of these terms of use are at any time found to be invalid or otherwise rendered unenforceable, that decision shall not invalidate or void the remainder of these terms of use. Any invalid or unenforceable provision shall be severable so that the validity or enforceability of the remaining provisions, or the validity of the provisions in question in any other jurisdiction, shall not be affected.
8. Termination
We reserve the right to block a User’s access to the Site immediately and without notice if, in good faith, we believe the User has failed to comply with any applicable laws or regulations or the terms and conditions of this Site.
9. Governing Law
These Terms of Use are governed by and shall be construed in accordance with Dutch law, without regard to or application of conflicts of law rules or principles. Your use of the Site and the Services may also be subject to other local, national and international laws. The United Nations Convention on Contracts for the International Sale of Goods will not apply
PRODUCT / SERVICE SPECIFIC T&C
MODULE: CW Covid19 Widget
1.1. Module CW All terms in this Module CW (“CW Terms”) apply exclusively to the Covid19 information widget which compiles and makes available information regarding Covid19-related travel issues from third party data sources (“Widget”). You, the user, must review and determine the accuracy, suitability, and consequences of using the Widget for your particular circumstances. The Widget is available to you, subject to these CW Terms. T&C of general application, including those into which CW Terms are incorporated shall apply to Widget as though repeated herein however these CW Terms are not applicable to any other CWT products or services. No other product or service specific terms apply to the Widget. In the event of a conflict between any CW Term and another applicable term, the CW Term shall prevail with respect to Widget.
1.2. Third Party Provider. Visa Run Inc., doing business as Sherpa independently compiles, monitors and provides the Widget using tools and sources selected and monitored by Sherpa. CWT does not guarantee the accuracy, timeliness or reliability of either this information or Sherpa’s verification processes.
1.3. No Professional Advice Do not consider any information contained in or provided by the Widget as professional or legal advice. Note that outputs provided may not be relevant to your particular circumstances. Please consult with public authorities and/or primary local information sources directly in one or more relevant locations and jurisdictions to validate the general information provided by the Widget.
1.4. Your Responsibility to validate Information 1.1. CWT does not accept liability or responsibility for any omissions, errors or inaccuracies, or timeliness of the information provided through the Widget. Diverse and fast changing local responses to COVID-19 can quickly render information outdated or inaccurate. Accordingly, you are responsible for independently informing and updating yourself of applicable restrictions or requirements for any actual or proposed trip.
1.5. No Warranties The Widget is provided on an “as is” and “as available” basis as made available from the Third Party Provider. CWT disclaims any representations, warranties or conditions of any kind, whether expressed or implied, and including without limitation implied representations.
1.6. Disclaimer / Waiver 1.1. Neither CWT nor any third party provider will under any circumstances be liable in any way for any loss or damages (direct, indirect, special, economic, incidental, consequential, punitive or exemplary, including without limitation loss of revenue, data, anticipated profits or lost business) in respect of use of, or inability to use, or any reliance on, the Widget, any of its content or links (including without limitation any inaccuracies or viruses), or any web browser or other equipment. In the event that CWT is nevertheless determined by a court of competent jurisdiction to be liable to you, you agree the maximum amount of damages that can be awarded to you will be equal to Euros (€50).
